Parking disputes are among the most common issues faced by housing societies. From vehicles parked in unauthorised spaces to members demanding additional parking for multiple cars, disagreements can quickly turn into legal disputes.

A recent order of the Maharashtra Co-operative Appellate Court has addressed one such issue and clarified an important point: a housing society can take action against a vehicle parked improperly, including the use of a wheel jammer, but it must follow the prescribed procedure.

⚖️ Society Can Use a Wheel Jammer Against Unauthorised Parking

The court considered the society's decision to use wheel jammers against vehicles that were parked in unauthorised areas.

The ruling recognised the society's authority to enforce its parking-related decisions, particularly where the society had taken a decision through its General Body and in accordance with its applicable rules and bye-laws.

However, this authority is not unrestricted. The society must follow due process before taking such action.

⏰ 48-Hour Prior Notice Is Important

One of the most significant conditions highlighted by the court is the requirement of 48 hours' prior written notice before clamping a vehicle.

This means a society should not simply place a wheel jammer on a vehicle without first informing the member.

The notice should give the vehicle owner an opportunity to understand the violation and take corrective action.

📝 Reasons for Clamping Should Be Clearly Mentioned

The notice should also contain cogent reasons explaining why the vehicle is being clamped.

This is important because parking enforcement should not appear arbitrary. A member should be able to understand what rule has allegedly been violated and why the society is proposing to take action.

Proper documentation can also help prevent further disputes between the society and its members.

🏢 General Body Decisions Have an Important Role

In the case, the society had passed a resolution relating to the use of wheel jammers with a three-fourths majority.

The court took into account the importance of decisions made through the society's democratic process.

Housing societies generally function through their General Body, managing committee, registered bye-laws and applicable cooperative laws. Members are expected to comply with valid decisions taken through these mechanisms.

🚙 Owning Multiple Cars Does Not Automatically Mean Multiple Parking Rights

The dispute also involved the issue of parking for multiple vehicles.

The court considered that simply owning several vehicles does not automatically give a member an unrestricted right to occupy multiple parking spaces within the society premises.

Parking spaces are subject to the society's applicable rules, availability and decisions governing their use.

This makes it particularly important for societies to maintain clear and transparent parking policies.

⚖️ Members Must Follow Valid Society Rules

The ruling also reinforces a broader principle of cooperative housing society management: members cannot simply disregard valid rules or resolutions because they disagree with them.

At the same time, societies must also ensure that enforcement is carried out properly and within the framework of the applicable law and bye-laws.

In other words, both sides have responsibilities — residents should follow valid parking rules, while societies should follow proper procedures when enforcing them.

📌 The Parking Dispute Is Not Completely Over

The court's order was an interim decision, meaning the larger dispute concerning parking rights had not been finally settled.

However, the order provides an important practical takeaway for housing societies dealing with unauthorised parking: enforcement measures such as wheel jamming may be possible, but they should be backed by proper authority, documentation and notice.

🏠 What Should Housing Societies Do?

To avoid unnecessary parking disputes, societies should consider:

  • Clearly defining authorised and unauthorised parking areas.
  • Maintaining proper parking records and allotment details.
  • Ensuring parking rules are communicated to all members.
  • Following the society's registered bye-laws and valid General Body resolutions.
  • Giving the required written notice before taking enforcement action.
  • Clearly documenting the reason for any action taken.
  • Applying parking rules consistently to all members.
