⚖️ The Maharashtra State Consumer Disputes Redressal Commission has directed Skyline Developers to pay ₹1.21 crore to two flat owners in Matunga over unpaid redevelopment compensation, transit rent and delayed possession. The commission also ordered the developer to pay 8% annual interest on ₹88 lakh in enhanced Floor Space Index (FSI) compensation and register the Permanent Alternate Accommodation Agreement within 60 days.

🏗️ Redevelopment Dispute Over Unpaid Dues

The case concerns two flat owners in the Magan Vihar property in Matunga, who, along with their late mother, had entered into redevelopment agreements with the developer in 2010 and 2015. Although possession of Flat No. 402 was handed over in May 2018, several contractual obligations allegedly remained unfulfilled.

💰 The complainants sought ₹88 lakh in enhanced FSI compensation following an increase in FSI from 2.5 to 3. They also claimed ₹6.60 lakh in unpaid transit rent for December 2017 to April 2018, ₹16.50 lakh as a penalty for delayed possession and ₹10 lakh towards raw materials purchased.

⚖️ Commission Finds Deficiency in Service

The commission held Skyline Developers guilty of deficiency in service and unfair trade practices. It noted that the developer had failed to fulfil its contractual commitments and had not contested the complaint. Consequently, the proceedings continued ex parte, with the complainants’ documentary evidence and submissions remaining unchallenged.

📄 The commission also considered the failure to register the Permanent Alternate Accommodation Agreement despite possession being handed over. It examined a subsequent demand for approximately ₹30.26 lakh over alleged unauthorised alterations in the context of the outstanding obligations.

💵 Compensation and Agreement Registration Ordered

The compensation includes ₹88 lakh in enhanced FSI compensation, ₹6.60 lakh in transit rent, ₹16.50 lakh in delay penalties and ₹10 lakh towards raw materials. The commission additionally awarded ₹1 lakh for mental agony and harassment and ₹50,000 towards litigation costs.

📌 The developer must also pay 8% annual interest on the ₹88 lakh FSI compensation from the date of default until payment. The commission directed Skyline Developers to execute and register the Permanent Alternate Accommodation Agreement dated February 18, 2015, within 60 days of receiving the order. Applicable stamp duty and registration charges for 1,000 sq. ft. of carpet area must be borne by the developer.

🏘️ Key Takeaway for Housing Societies

The ruling highlights the importance of developers fulfilling redevelopment agreements, clearing pending compensation and completing property registration formalities.

📂 Housing society members should maintain copies of redevelopment agreements, payment records, correspondence and possession documents to protect their interests if disputes arise. Other flat owners facing similar issues should review their agreements and seek appropriate legal advice, as the relief granted in this case depends on its specific facts and findings.
