The Maharashtra Real Estate Regulatory Authority (MahaRERA) has passed an important ruling in a dispute between a Pune homebuyer and Lodha Developers, highlighting the significance of timely agreement execution in real-estate transactions. The case revolved around a flat booked in the “Kharadi Pune Phase II Tower 8” project located in Wagholi, Pune, with the property reportedly valued at around ₹1.49 crore.

The homebuyer had approached MahaRERA seeking additional clarifications before signing the Agreement for Sale. Concerns were raised regarding 🚗 parking allocation, project-related disclosures, and certain contractual terms. However, MahaRERA observed that the required project details were already available on the official portal and stated that the complaint was “premature and not maintainable.”

According to the authority, the buyer had access to all essential project-related information through the MahaRERA website before proceeding with the purchase. The regulator emphasized that buyers should verify all disclosures uploaded on the portal instead of delaying agreement execution without sufficient grounds.

⚖️ Developer’s Cancellation Notice Also Set Aside

While dismissing the buyer’s complaint, MahaRERA also ruled against the developer on one important issue. Lodha Developers had issued a booking cancellation notice to the buyer during the pendency of the complaint.

MahaRERA stated that such action violated principles of natural justice and therefore set aside the cancellation notice. This observation highlights that developers cannot proceed with arbitrary termination while legal proceedings are ongoing.

📝 Buyer Given 30 Days To Sign Agreement

The authority has now directed the homebuyer to execute and register the Agreement for Sale within 30 days from the date of the order. This provides the buyer with a final opportunity to continue with the transaction and complete the legal formalities.

The order sends a clear message that agreements must be executed within a reasonable timeframe once all mandatory disclosures are available.

💰 2% Amount May Be Forfeited If Buyer Fails

MahaRERA further clarified that if the buyer fails to sign the agreement within the given timeline, the developer will be permitted to cancel the booking and forfeit 2% of the total flat consideration value, as per MahaRERA Order No. 60 of 2024.

This provision aims to ensure discipline and accountability in property transactions while protecting the interests of both buyers and developers.
