Mumbai: Maharashtra’s proposed housing society bye-laws have received more than 5,000 suggestions and objections from residents, housing societies and federations. 🏢 The feedback mainly focuses on parking, EV charging facilities, maintenance charges and the powers of managing committees. The new bye-laws are intended to provide clearer and more comprehensive rules for the state’s housing societies.
🚗 Parking and EV Charging Take Centre Stage
A major portion of the suggestions relates to parking and electric vehicle charging. Residents have sought clearer categorisation of open, stilt and podium parking, along with better clarity on common parking areas and their maintenance.
⚡ Suggestions on EV charging have called for housing societies to provide space for common charging stations and take responsibility for their maintenance. Equipment installed exclusively by an individual member in their allotted parking space would remain the member’s financial responsibility.
💰 Maintenance Charges Under Discussion
The draft bye-laws propose a standardised approach to maintenance charges. Common service charges would be divided equally among flats, while water charges would be calculated based on the number and size of taps or inlets. 💧
However, some owners of smaller flats have raised concerns and suggested that maintenance charges should instead be calculated according to flat area. This has emerged as one of the key areas of feedback received by the authorities.
🏢 Managing Committee Powers Questioned
Another significant area of concern is the scope of powers given to managing committees. Several suggestions have called for greater clarity and limits on committee powers, particularly regarding NOCs and sale- or lease-related matters.
📋 The suggestions are being reviewed, with changes to be considered where they fall within the applicable rules and laws.
📅 Bye-Laws Expected to Be Finalised in October
The committee reviewing the draft is expected to finalise the new bye-laws by the first week of October 2026, with officials indicating that around 90% of the work has already been completed.
Once the new bye-laws are published, housing societies will be required to adopt them within three months. Any society-specific changes would also require approval from the registrar. 📝
