Maharashtra Housing Societies: General Body Now in Charge of Redevelopment

The Maharashtra Registrar of Co-operative Societies has issued a game-changing circular giving full control of redevelopment decisions to the General Body of housing societies. This move removes the long-standing requirement for a “No Objection Certificate” (NOC) from the Registrar, which often delayed projects for years.

🔑 Key Changes

  • General Body = Final Authority: All redevelopment or self-redevelopment decisions are now decided by society members collectively.
  • Registrar’s Role Reduced: The Registrar can only ensure proper procedures are followed; they cannot block or influence decisions.
  • NOC Requirement Scrapped: Societies no longer need approval from the Registrar before redevelopment.
  • Authorized Officer Appointment: Within 14 days of a special GBM notice, an officer must be appointed to monitor proceedings.
  • Documentation: Societies must submit minutes, members’ consent forms, and video recordings within 15 days.

📌 Why This Matters

Experts hail the circular as a landmark change, as it reduces bureaucratic delays, ensures transparency, and empowers society members. It also helps clear thousands of pending redevelopment disputes in courts, while speeding up redevelopment of aging buildings.

Members still retain the right to challenge decisions legally, but only after the GBM resolution is passed, ensuring accountability without slowing down the process.
