A significant ruling by the Income Tax Appellate Tribunal (ITAT), Mumbai, has brought relief to a homeowner who sold his redeveloped flat for ₹1.95 crore but faced a tax dispute with the Income Tax Department. The case highlights an important issue for housing society members: whether a flat received through redevelopment should be treated as an entirely new property when calculating capital gains tax. ⚖️ <text> </text>

🏠 How the Redevelopment Case Began

Mr. Rajesh Shamji Furia and his wife originally owned a 510-square-foot flat in Chunabhatti, Sion, Mumbai, purchased during the financial year 2006–07. Later, their housing society entered into a redevelopment agreement with a builder in 2013, under which they became entitled to a replacement flat with 30% additional carpet area.

The redeveloped flat was handed over under a Permanent Alternate Accommodation Agreement (PAAA) signed on January 12, 2018. Just eight days later, on January 20, 2018, the homeowner sold the flat for ₹1.95 crore and claimed long-term capital gains treatment, along with an exemption under Section 54F of the Income Tax Act, after reinvesting the proceeds in another residential property. <Cite refs={["turn842941search2","turn842941search3"]}/>

📄 Why Did the Income Tax Department Issue a Notice?

The Income Tax Department considered the redeveloped flat a newly acquired asset because the homeowner sold it only eight days after signing the PAAA. Consequently, the Assessing Officer classified the gains as short-term capital gains and rejected his claims for exemption and indexation benefits.

The department added ₹80.14 lakh to his taxable income, representing his 50% share of the disputed capital gains. After the first appeal also went against him, the homeowner challenged the decision before ITAT Mumbai. <Cite refs={["turn842941search2","turn842941search3"]}/>

⚖️ Why Did ITAT Mumbai Rule in His Favour?

The tribunal held that redevelopment does not ordinarily extinguish an existing homeowner’s property rights and create an entirely new capital asset. Instead, ownership rights can continue throughout redevelopment, with the new premises replacing the original flat.

The tribunal also observed that the PAAA documented the alternate accommodation to which the homeowner was already entitled under the redevelopment arrangement. Its signing date did not automatically become the starting point for calculating the property's holding period.

Even when the holding period was calculated from the 2013 development agreement rather than the original purchase, the property had been held for more than the required 24 months before its sale. The tribunal therefore accepted the long-term capital gains treatment in this case. <Cite refs={["turn842941search3","turn842941search4"]}/>

✅ What Was the Final Decision?

On July 16, 2026, ITAT Mumbai ruled in the homeowner’s favour and directed the deletion of the ₹80.14 lakh addition. It also allowed the applicable indexation and Section 54/54F exemption benefits in accordance with the law. <Cite refs={["turn842941search3","turn842941search4"]}/>

📢 What Does This Mean for Housing Society Members?

This ruling is important for members of housing societies planning to sell flats received through redevelopment. It highlights that the original property's holding period may remain relevant even when a builder provides a replacement flat with additional carpet area.

However, the decision does not mean every sale of a redeveloped flat is automatically tax-free. Capital gains treatment and exemptions depend on the facts of the transaction, applicable tax provisions and compliance with the relevant conditions.

📌 What homeowners should do:

  • Keep the original flat purchase documents and redevelopment agreement safely.
  • Maintain the PAAA, sale deed and records of any reinvestment.
  • Consult a qualified tax professional before selling a redeveloped property.
