Mumbai’s housing societies without an Occupancy Certificate (OC) may get an opportunity to regularise their buildings under the BMC’s OC amnesty scheme. However, societies will need to meet specific conditions and submit key documents before they can benefit from the scheme.

🏢 1. BMC Introduces OC Amnesty Scheme

The Brihanmumbai Municipal Corporation (BMC) has introduced an OC amnesty initiative aimed at helping eligible housing societies obtain an Occupancy Certificate for buildings that have remained without one. The move could provide relief to residents who have been facing difficulties because their buildings lack a valid OC.

📋 2. Absence of OC Alone Is Not Enough

Simply not having an OC does not automatically make a building eligible. Housing societies must demonstrate that the building had the necessary approvals at the time of construction and meets the conditions prescribed under the scheme.

🏗️ 3. IOD and Commencement Certificate Are Important

Societies applying under the scheme will need to establish the availability of key construction approvals, including the Intimation of Disapproval (IOD), approved building plans and Commencement Certificate (CC). These documents help establish that the building was constructed through the required approval process.

🤝 4. Developer’s NOC Is Required

Another important requirement is a No Objection Certificate (NOC) from the original owner or developer who submitted the development proposal or holds the relevant development rights. Societies should therefore verify their records and determine whether the required NOC can be obtained.

⚖️ 5. What If the Developer Does Not Give the NOC?

Obtaining a developer’s NOC can become difficult in older housing projects, particularly where the developer is unavailable or unwilling to cooperate. In such cases, the BMC may issue a notice under the Mumbai Municipal Corporation Act, 1888. The civic body has also sought amendments to address situations where societies are unable to obtain the required authorisation.

🏘️ 6. Relief for Thousands of Mumbai Homeowners

The scheme could have a significant impact across Mumbai. According to the report, around 12 lakh homeowners living in nearly 25,000 residential buildings do not currently have an OC. Regularisation could therefore provide considerable relief to residents and housing societies that have been dealing with the consequences of missing occupancy approvals.

📅 7. Cut-Off Date for Eligible Buildings

The scheme is intended for buildings that were occupied before November 17, 2016. Housing societies may need to provide supporting evidence, such as property-tax receipts or electricity bills, to establish that the building was occupied before the specified cut-off date.

🔎 What This Means for Housing Societies

For societies without an OC, the amnesty scheme could provide a significant opportunity to address long-standing documentation and approval issues. However, societies should first verify their IOD, CC, approved plans, occupation records and developer-related documents before proceeding.

The key takeaway is that the scheme is not an automatic OC waiver. Housing societies will need to satisfy the prescribed eligibility conditions and complete the required documentation to take advantage of the BMC initiative.
